Aggravating And Mitigating Factors

Drunk driving is an offense that is based on a six-level system in North Carolina. A level 1 charge is considered the most serious. There are several aggravating or gross aggravating factors that could raise the level of your offense, including:

  • High blood alcohol level: above .14 requires ignition interlock device
  • Driving without a license
  • Accident involving serious injury
  • Prior DUI convictions: if one within past seven years, it automatically rises to a level 2 offense
  • Presence of a minor child in the car: automatic 30 days minimum in jail

Even a low-level offense or breath test refusal results in the automatic loss of your driver's license. We can help you keep your driving privileges or obtain a limited privilege license.

There are also many mitigating factors that we can use to help reduce a charge to a lower level offense. These can include:

  • A lower blood alcohol content
  • Driving lawfully, excluding the suspected impairment
  • Safe driving record
  • Impairment from consumption of a legally prescribed medication
  • Voluntarily submitting to a medical assessment
