The Process Under North Carolina Law
After a petition is filed, two things must be established under North Carolina law before a judge will grant an order to terminate a parent's rights.
The first part of the process is establishing grounds for termination. A judge may consider 11 grounds for termination, which include:
- Abuse or neglect
- Nonpayment of child support
- Abandonment
- Failure to provide adequate care and supervision of the child
- Other statutory factors
The second part of the process involves determining whether the termination of the parent's rights would be in the best interest of the child. Factors that a judge will consider are:
- Age of the child
- The bond between the minor child and the parent named in the petition
- What the likelihood is that the child may be adopted
- The relationship between the child and the proposed legal guardian, adoptive parent or individual who would be granted sole custody
- Any other factors that the judge deems relevant
If both of these are established, a judge can terminate a parent's rights and obligations to their child.
